The overlay trap

Overlays do not make a site compliant, and they have become a frequent target for accessibility lawsuits.

Accessibility "widgets" sit on top of a site. They hide problems from automated checkers; real users, screen readers and the courts still run into them. In 2025 the US regulator fined the largest overlay vendor $1 million for false compliance claims, and roughly 4 in 10 companies sued for accessibility that year already had one installed.

Enforcement in practice

The European Accessibility Act applies across all 27 member states since June 2025, and regulators are checking. One national regulator examined its 100 biggest webshops: 61% made ordering impossible for people with disabilities and another 33% had serious barriers. A French court has already ordered a major retailer to make its site and app accessible, under a penalty for every day of delay.

Questions

Does it catch every accessibility problem?

Automated testing reliably catches about a third of WCAG issues: the ones machines can see, like contrast, missing alt text and broken labels. We flag those precisely and recommend a manual review for the rest.

Do you use an accessibility overlay?

No, and we would advise against one. Overlays hide problems from automated checkers, but users and the courts still run into them. In 2025 the US regulator fined the largest overlay vendor $1 million for false compliance claims. We test your real markup and tell you how to fix it at the source.

What can I show a regulator?

Every scan, claimed fix and verification is logged with a timestamp, so you keep a dated record of good-faith remediation. You also get an EN 301 549 accessibility statement generated from your latest scan. This is evidence an overlay cannot produce.

Can I put my own brand on the reports?

Yes. On the Agency plan, PDF reports use your logo and agency name with no Conforma mark.

Does the EU Accessibility Act apply to me?

Since 28 June 2025 the EAA covers consumer-facing services in the EU: e-commerce, banking, ticketing, telecoms, transport and e-books. Micro-enterprises (under 10 staff and €2M turnover) are exempt for services, and pre-existing services have a transition period to 2030. Conforma tests against WCAG 2.2 AA / EN 301 549 and generates the paperwork, so you can show clients exactly where they stand.
